Users are limited to a single profile, either as a "Provider" or a "Seeker." Those with multiple profiles may face consequences detailed in this Agreement.

You must maintain the confidentiality of your account and password. You are responsible for all activities on your account. If you suspect unauthorized use or security breaches, notify us through our contact-us page promptly. If necessary, change your password through the Registration Details page.

Do not share, rent, lease, or grant access to your account, and don't charge for administrative privileges. We retain the right to disable any username, password, or identifiers at our discretion, including for agreement violations.

We are not accountable for losses resulting from unauthorized use of your account, whether you were aware of it. However, you may be responsible for losses incurred by others or us when someone else uses your account or password.

You must not use anyone else's account at any time.

Although we give high priority to safeguarding your personal information, we cannot guarantee that unauthorized individuals will never breach our website's security measures or misuse the information you provide.

You are required to upload a genuine photo of yourself alongside a government-issued ID, passport, or driver's license, with your photo on it (this information is not publicly visible, only for verification purposes). Uploading irrelevant images that do not match the requested documentation will be considered an intentional attempt to evade verification, and you may face deactivation until the necessary documentation is provided.

Uploaded files should have appropriate quality, size, and resolution to ensure clear identification. Illegible images, or potentially doctored images will be rejected.

We aim to review and approve your submissions and verify your profile within 24-48 hours, typically much sooner. However, in some cases, it may take longer, in which case please allow 72 hours before contacting us about verification.

Members providing counterfeit or falsified IDs will have their membership terminated immediately, and any future registration attempts will be declined. Any Members who fail to provide valid verification documentation when requested will forfeit any accumulated credits, excluding purchased credits.

Verification photos are intended to help Customers make informed judgments about compatibility based on the authenticity of profile content. If the authenticity of a profile or its content is questioned, the profile may be suspended, and Members may be required to provide verification details to confirm their identity or demonstrate permission/rights to upload the content in question.

Provider Account and Provider Offerings

To become a Provider, you must complete the registration form and provide a copy of your valid government-issued photo identification, which must include your full legal name, date of birth, and expiration date. This is necessary for age and identity verification.

As a Provider, you will create a profile (referred to as the "Provider Profile") on our websites. This profile is where you can showcase and offer various content and services for sale, including videos, photos, live streams, and any other features available now or in the future (collectively known as "Provider Offerings"). Your profile picture or avatar must accurately represent your appearance.

Providers have the freedom to create, upload, send, or display various media, content, and materials of their own creation, such as photos, videos collectively referred to as "Provider Content." We do not control how or when you create your Provider Content, including the time and location of its creation. You are solely responsible for providing any necessary clothing, makeup, accessories, tools, equipment, and resources for producing your Provider Content. We merely provide the means for distributing your Provider Content through our Websites.

Provider Content must not include third-party intellectual property, such as copyrighted material, unless you have obtained written permission or have legal entitlements, such as fair use. Any individuals involved in creating, producing, or appearing in your Provider Content must be your employees or contractors, and you are fully responsible for them. Each such individual must sign written agreements, securing the rights and consents before participating in any Provider Content related to this agreement.

All forms of Provider Content exchanged with Discreet Companions site(s) or Members must be in English. Providers are prohibited from:

• Using terms like "Verified," "Recommended," or "Official" in titles, profiles, sale items, or any fields linked to a Provider, except as specified in the Agreement.
• Using the phrase "Available Today" in Profile Summaries, Profile Pictures, or Member nicknames.
• Repeatedly removing, deleting, or re-uploading content in an attempt to increase profile exposure.
• Including email addresses, telephone numbers, physical addresses, or URLs/links to other websites in profiles or content. Use the designated contact section in your dashboard for such information.

Ownership of Provider Content
We do not claim ownership of your Provider Content. You retain any ownership rights you have in your Provider Content.

License Granted to Seekers
You grant Seekers accessing your Provider Content through our Websites a nonexclusive license to use your content for personal, non-commercial purposes as enabled by our website features.

License Duration
Licenses granted continue for a reasonable period after you remove your Provider Content from your account. Seekers' licenses for downloaded Provider Content do not terminate if they comply with this agreement. We may retain server copies of removed Provider Content.

Use of Provider's Name, Likeness, and Information
We have the right to use your fictitious name, image, likeness, and biographical information for promotional purposes, including advertising our Websites, Provider Profiles, Provider Content, and Provider Offerings.

Moral Rights Waiver
You waive any "moral rights" you may have in your Provider Content.

Providers must comply with record-keeping and labelling requirements for Provider Content containing sexually explicit conduct. You must maintain records to demonstrate compliance and act as the "Custodian of Records."

We review all non-live Provider Content before it is published to our websites to ensure that the Provider Content is not illegal and does not otherwise violate the Content Standards.

The Provider may sell Provider Offerings to Seekers in exchange for Virtual Money (Credits). The Provider is solely responsible for setting prices in Virtual Money (Credits) for the Provider Offerings. Seekers must submit pay for Provider Offerings using Virtual Money (Credits) purchased through our websites.

All transactions and interactions facilitated through our websites are agreements between the Seeker and the Provider. Although we facilitate transactions and interactions between Seekers and the Provider by providing our website, hosting and storing Provider Content, and acting as a payment intermediary, we are not a party to any agreement that may exist between a Seeker and the Provider. We are not responsible for any transactions or interactions between Seekers and the Provider.

Payouts

• Providers can withdraw Provider Earnings using the Earning request, on condition that the Provider Earnings meet the minimum payout requirements. We reserve the right to ask for any necessary identification as required by the Provider’s selected payment processing partners to comply with international anti-money laundering and other regulations before releasing payment.
• If the Provider is an entity or sets up an entity to receive Provider Earnings, the Provider must provide evidence to us on request that the Provider is the Person with Majority Control of that entity. Except as provided otherwise in this agreement, we will only pay Provider Earnings into a bank account not held in the Provider’s name where the bank account is held in the name of an entity and the Provider is the Person with Majority Control of that entity. If the Provider uses an entity to receive Provider Earnings, the Provider must comply with all laws (including Tax laws) that are applicable to entities in the place where the entity is established. For purposes of this agreement, (1) “Person with Majority Control” means any individual who meets one or both of the following conditions with respect to an entity: (A) the individual holds, directly or indirectly, more than 50% of the ownership interest in that entity; or (B) the individual holds, directly or indirectly, more than 50% of the voting rights in that entity; and (2) “Tax” means all forms of tax and statutory, governmental, state, federal, provincial, local government, or municipal charges, duties, imposts, contributions, levies, withholdings, or liabilities wherever chargeable in any jurisdiction.
• If we cannot pay out the Provider Earnings to the Provider after 12 months because of inaccurate information in the Provider’s account and we cannot contact the Provider, the Provider will automatically forfeit the Provider Earnings, and the Provider Earnings will become our property. Provider Earnings that are deemed unclaimed property may be turned over to the applicable governmental body.

Provider Earnings Withholdings

• We may withhold any part of the Provider Earnings due to the Provider but not yet paid out: (i) if we believe that the Provider has or may have seriously or repeatedly breached any part of this agreement or applicable law; (ii) if the Provider attempts or threatens to breach any part of this agreement in a way that we believe could have serious consequences for us or another user (including actual or possible loss caused to us or another user); or (iii) if we suspect that any part of the Provider Earnings results from unlawful activity, either by the Provider or by the Seeker who made the Seeker Payment resulting in the Provider Earnings, for as long as is necessary to investigate the actual, threatened, or suspected breach by the Provider or the suspected unlawful activity (as applicable). If after our investigation, we conclude that (i) the Provider has seriously or repeatedly breached any part of this agreement or applicable law; (ii) the Provider has attempted or threatened to breach any part of this agreement in a way that has or could have serious consequences for us or another user (including actual or possible loss caused to us or another user); or (iii) the Provider Earnings results from unlawful activity, we may notify the Provider that the Provider has forfeited the Provider Earnings.
• We will not have any responsibility to the Provider if we withhold or forfeit Provider Earnings where we have the right to do so under this agreement.
• If we are withholding part of the Provider Earnings due to the Provider, and we determine that part of the Provider Earnings withheld is unrelated to the Provider’s breach or suspected unlawful activity, we may pay the Provider the Provider Earnings unrelated to the Provider’s breach or suspected unlawful activity. However, the Provider acknowledges that if we determine that the Provider’s breaches have or may cause us losses, we may withhold all the Provider Earnings due to the Provider but not yet paid and we may set off those amounts against any losses we suffer.
• If after we conclude our investigation, we determine that Provider Earnings are forfeited, we will use our reasonable efforts to return any Seeker Payments that resulted in forfeited Provider Earnings to the relevant Seekers who paid them.

Taxes
We recommend that all Providers seek professional tax advice to ensure that the Provider is compliant with the Provider’s local Tax and VAT rules, based on the Provider’s individual circumstances. By using our websites as an Provider, you state that you have reported and will report in the future the receipt of all payments made to you in connection with your use of our Websites to the relevant Tax authority in your jurisdiction, as required by law. By using our websites as an Provider, you further state that you will at all times comply with all laws and regulations relating to Tax that apply to you. The Provider is solely responsible for the Provider’s own Tax affairs, and we are not responsible or liable for any non-payment of Tax by the Provider. We may close the Provider’s account if we are notified of or become aware of any Tax non-compliance by the Provider.

Disputes
If the Provider disputes our Provider Earning calculation, the Provider must notify us in writing no later than 30 days after that disputed calculation. Failure to notify us within this period will result in the Provider’s waiver of any claims related to that disputed calculation.

The Provider states that the following facts are accurate and will continue to be accurate during this agreement:

• If the Provider is an individual, the Provider is at least 18-years old and has the legal capacity to enter into this agreement. If the Provider is an entity, it is duly organized, validly existing, and in good standing as a legal entity under the laws of its jurisdiction of incorporation, organization, or chartering.
• The Provider has the power to enter into this agreement, to grant the rights and licenses granted in it, and to perform the Provider’s obligations in this agreement.
• The Provider is duly licensed, authorized, and certified by all applicable governmental and regulatory authorities to perform the Provider’s duties and obligations under this agreement.
• The Provider is not, nor is the Provider acting for any person or entity that is, a Specially Designated National (SDN), as OFAC may designate on one or more occasions.
• The Provider has independently evaluated the desirability of participating on our websites, and the Provider has not relied on any statement other than those in this agreement.
• The Provider’s performance of this agreement will not conflict with or violate (a) any order, judgment, or decree that applies to the Provider; or (b) any agreement that applies to the Provider.
• The Provider’s performance under this agreement will not:
  1. invade the right of privacy or publicity of any person (including invasion of rights of celebrity).
  2. involve any defamatory, obscene, indecent, or otherwise unlawful material.
  3. violate any applicable law
  4. otherwise infringe on the rights of any third parties, including those of copyright, patent, trademark, service mark, trade name, trade secret, or other intellectual property rights, or engage in false advertising, unfair competition, violation of antidiscrimination law, or violation of any other right of any person.
• The Provider Content complies with this agreement.
• The Provider holds all rights necessary to grant the licenses granted in this agreement.
• The Provider either owns the Provider Content (and all intellectual property rights in it) or has a valid license to offer and supply the Provider Content on our Websites.
• If the Provider Content includes third-party material, the Provider has secured all rights, licenses, written consents, and releases that are necessary for the Provider to use that third-party property in the Provider Content or the Co-Authored Provider Content and for the later use and exploitation of that Provider Content or Co-Authored Provider Content under this agreement.
• The Provider Content is of satisfactory quality, taking account of any description of the Provider Content, the price, and all other relevant circumstances, including any statements or representation that the Provider makes about the nature of the Provider Content on the Provider’s account or in any advertising.
• The Provider Content does not depict any individual under 18-years old.

We reserve the right to take the following actions at any time:

• Remove or decline to publish any Seeker Contributions or Provider Content at our sole discretion, with or without a reason. Grounds for removal or rejection may include violations of this agreement, legal issues, or breaches of applicable law.
• Implement any necessary or appropriate measures regarding Seeker Contributions or Provider Content as we see fit, including situations where we believe that Seeker Contributions or Provider Content violates this agreement, infringes on intellectual property rights, poses a threat to personal safety, may result in liability for us, or contravenes applicable law.
• Disclose your identity or other information as required by applicable law or a court or to anyone claiming that material posted by you violates their rights, including intellectual property rights, or invades their right to privacy or publicity.
• Take legal action, including involving law enforcement, in response to any illegal or unauthorized use of our website, including the posting of illegal or unauthorized Seeker Contributions or Provider Content. We may pursue legal remedies for breaches of this agreement or any other illegal activities. We will also report any Seeker Contributions or Provider Content that might be exploitative of children to relevant authorities, including the National Centre for Missing and Exploited Children’s Cyberviolence and other relevant legal and regulatory bodies.
•  Terminate or suspend your account or access to any part of our website, with or without a reason, including (i) breaches of this agreement; (ii) infringement of intellectual property rights by Seeker Contributions or Provider Content; (iii) fraudulent, illegal, or suspicious activity; (iv) activities threatening personal safety or causing reputational harm to us; or (v) violations of applicable law.

Our policy is to suspend access to any Seeker Contributions or Provider Content that may not comply with this agreement or applicable law while investigating suspected non-compliance or unlawfulness. If we suspend access to your Seeker Contributions or Provider Content, you have the right to request a review of our decision by contacting us. After our investigation into the suspected non-compliance or unlawfulness of the content, we may take appropriate action, including reinstating access, permanently removing, or disabling access to that content, without requiring your consent or prior notice. You must provide reasonable assistance at your own expense, including providing requested information, during our investigation. We are not liable for any losses you incur due to the suspension of access to your Seeker Contributions or Provider Content or any other measures we take in good faith to investigate suspected non-compliance or unlawfulness under this agreement.

In the event of suspending access to or removing your Seeker Contributions or Provider Content, we will notify you via email or electronic message to your user account. However, prior notice of removal is not obligatory.

If we suspend access to your account or terminate your access to our websites, we will notify you via email to the address listed in your account. During the suspension period, we may withhold any Seeker/Provider Earnings/credits owed to the Provider but not yet paid. Upon termination, your access to our Website will cease, and all licenses granted by us will be revoked. We will remit any outstanding and undisputed Seeker/Provider Earnings/credits earned under this agreement to the Seeker/Provider no later than 15 days after termination, subject to section 12.11(b) (Seeker/Provider Earnings/credits Withholdings). Additionally, the Seeker/Provider acknowledges that we may offset any Seeker/Provider Earnings/credits owed to the Provider against any losses incurred under section 20 (Indemnification).

We will fully cooperate with any law enforcement authorities or court order requiring or directing us to disclose the identity or other information of any individual posting content on or through our websites, including the Interactive Services.

We conduct pre-publication reviews of all Seeker Contributions or Provider Content to attempt to ensure their legality and compliance with this agreement. However, we do not endorse the opinions expressed in Seeker Contributions, Provider Content, or the Interactive Services. We assume no liability for any actions or inactions related to transmissions, communications, or content provided by any user or individual. Furthermore, we bear no responsibility or liability to anyone for the execution or non-execution of the activities described in this agreement.

Do not impersonate others. You are responsible for your profile content, emails, messages, and interactions. Comply with all laws and regulations, and do not attempt unauthorized access to computer systems or networks. Do not transmit unlawful or harmful material.

Discreet Companions may terminate your access for any reason, including breach of this agreement. Termination may occur without prior notice and may include deleting your account and files.

Discreet Companions does not endorse or take responsibility for third-party content, products, or materials. You assume any risk associated with dealings with third parties.

Content on this site is protected by copyrights, trademarks, and other proprietary rights. You may download and print material for personal, non-commercial use with authorization. Posted material may be used by Discreet Companions for various purposes.

This site and its materials are provided "as is" without warranties.  Discreet Companions does not guarantee uninterrupted or error-free access. Material accuracy, timeliness, and reliability are not guaranteed.

Discreet Companions shall not be liable for any damages, including direct, indirect, or incidental, arising from site use.  Discreet Companions is not responsible for offensive or illegal content.

Payments and Subscriptions
Refunds are generally non-transferable and non-refundable. Exceptions may be considered in specific cases. Violation of terms and conditions may result in no refund.

Discreet Companions may delete suspicious or fraudulent accounts without notice.
